A question I receive often is concerning the rules for building a new dock or repairing an existing dock.  To build a new dock or repair an existing dock on Lake of Bays, you must comply with both the requirements of the Ministry of Natural Resources and Forestry (MNRF) and the Township of Lake of Bays. Here’s a summary of what you need to know:

Ministry of Natural Resources and Forestry (MNRF) Requirements:

  1. Work Permit for Over-Water Structures: A MNRF work permit is required for all structures over the water greater than 15 square meters (161 square feet). This includes docks, boathouses, boat ports, and any other structure over the water.
  2. Scope of the Permit: The 15 square meter threshold includes the footprint or shadow over the water (measured on the perimeter) and applies to floating docks, as well as the repair and replacement of existing docks, boathouses, and boat ports.
  3. Application Process: Applications for the MNRF work permit can be made via the [MNRF website] (https://www.ontario.ca/page/crown-land-work-permits).

Township of Lake of Bays Requirements:

  1. Building Permits: As of January 3, 2023, all new applications must be submitted through Cloudpermit. Building permits are mandatory to ensure compliance with the minimum standards of the Ontario Building Code, which cover aspects like design, construction, quality of materials, and environmental protection
  2. Size Threshold for Permit: A building permit is required for a dock, boathouse, or boat port that is 10 square meters (108 square feet) or greater.
  3. Pre-requisites for Township Building Permit: Before the Township can issue a building permit for any over-water structure larger than 161 square feet, a MNRF work permit must be obtained
  4. Additional Requirements: For steel docks supporting a structure, compliance with the Steel Dock with Structure Permit Policy is required. Approval or a permit number from the Ministry of Natural Resources and the Department of Fisheries and Oceans may also be needed, particularly for docks with cribs exceeding 161 square feet
